- The slow crack propagation resistance reported after 300 hours in example 3 was actually measured on its first surface of the specimen whereas, as noted previously, the test conditions dictate the measurement should be undertaken on the outer surface of the test specimen.
- The slow crack propagation resistance of R30 orof=0.25 was measured after 1100 hour at 45°C. The claim provides for a slow crack propagation resistance of at least 1000 hours at 45°C. This test was therefore not in compliance with the conditions of the claim, and is therefore invalid.
- The imprecise and incomplete nature of the slow crack propagation resistance report for example 4 is reflected in its subsequent use with the words “it shows a slow crack propagation resistance of 965 hours” in claim 1.
- The trend for the slow crack propagation resistance reported on sealing film number 4 (in example 4) was approximately proportional to the softening point and, in particular, decreased exponentially with increasing degrees of polymerisation. This was not pointed out in the patent or in D16 and there is no evidence that the patentees considered this important within the context of the invention.
